Based on an unannounced, onsite home care agency state relicensure survey conducted on February 22, 2024, Medstaffers, was found to be in compliance with requirements of 28 PA Code, Part IV, Health Facilities, Chapter 51, Subpart A.

Based on an unannounced, onsite home care agency state relicensure survey conducted on February 22, 2024, Medstaffers, was found not to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 611, Subpart H. Home Care Agencies and Home Care Registries.

611.51(a) LICENSURE
Hiring or Rostering Prerequisites

Name - Component - 00
Prior to hiring or rostering a direct care worker, the home care agency or home care registry shall: (1) Conduct a face-to-face interview with the individual. (2) Obtain not less than two satisfactory references for the individual. A satisfactory reference is a positive, verifiable reference, either verbal or written, from a former employer or other person not related to the individual that affirms the ability of the individual to provide home care services. (3) Require the individual to submit a criminal history report, in accordance with the requirements of § 611.52 (relating to criminal background checks), and a ChildLine verification, if applicable, in accordance with the requirements of § 611.53 (relating to child abuse clearance).

Observations:


Based upon review of employee files (EFs) and interview with agency chief operations officer (EMP #1), agency failed to provide documentation of two satisfactory, references for one (1) of ten (10) EFs reviewed. (EF# 6)
Findings include:
Review of EFs conducted on February 22, 2024 between approximately 11:00 a.m. and 12:30 p.m. revealed the following:
EF# 6, Date of Hire (DOH), 9/30/2022: no documentation of two satisfactory references conducted prior to hire. One reference conducted on 9/27/2022. One family reference conducted on 9/27/2022.

An interview with the agency EMP #1 conducted on February 22, 2024 at approximately 2:30 p.m. confirmed the above findings.







Plan of Correction:

Training with internal staff on 2/23/2024
that references cannot be someone related to the applicant.

One satisfactory reference will be obtain for EF#6.

Human Resources will monitor new applicants files to ensure the two reference checks are not related. Human Resources will not release file to be able to start work until two satisfactory references are completed.




611.52(c) LICENSURE
Federal Criminal History Record

Name - Component - 00
If the individual required to submit or obtain a criminal history report has not been a resident of this Commonwealth for the 2 years immediately preceding the date of the request for a criminal history report, the individual shall obtain a federal criminal history record and a letter of determination from the Department of Aging, based on the individual ' s Federal criminal history record, in accordance with the requirements at 6 PA. Code § 15.144(b) (relating to procedure).

Observations:


Based upon review of employee files (EFs) and interview with agency chief operations officer (EMP #1), agency failed to obtain a federal criminal history record and a letter of determination from the Department of Aging, based on the individual's Federal criminal history record, in accordance with the requirements at 6 PA. Code 15.144 (b) (relating to procedure) for two (2) of ten (10) EFs reviewed. (EF# 2 and EF# 10)
Findings include:
Review of EFs conducted on February 22, 2024 between approximately 11:00 a.m. and 12:30 p.m. revealed the following:
EF# 2, Date of Hire (DOH), 12/1/2023: No Federal criminal history record and a letter of determination obtained from the Department of Aging.
EF# 10, DOH, 1/11/2024: No Federal criminal history record and a letter of determination obtained from the Department of Aging.

An interview with the agency EMP #1 conducted on February 22, 2024 at approximately 2:30 p.m. confirmed the above findings.







Plan of Correction:

Correct codes from IdentGo ordered, 1KG8RJ which the results will come from Department of Aging per the regulations.

Human Resources trained on the correct codes to use for all new applicants.


611.52(d) LICENSURE
Proof of Residency

Name - Component - 00
The home care agency or home care registry may request an individual required to submit or obtain a criminal history record to furnish proof of residency through submission of any one of the following documents:
(1) Motor vehicle records, such as a valid driver ' s license or a State-issued identification.
(2) Housing records, such as mortgage records or rent receipts.
(3) Public utility records and receipts, such as electric bills.
(4) Local tax records.
(5) A completed and signed, Federal, State or local income tax return with the applicant ' s name and address preprinted on it.
(6) Employment records, including records of unemployment compensation

Observations:


Based upon review of employee files (EFs) and interview with agency chief operations officer (EMP #1), agency failed to ensure proof of residency for two (2) of ten (10) EFs reviewed. (EF# 2 and EF# 10)
Findings include:
Review of EFs conducted on February 22, 2024 between approximately 11:00 a.m. and 12:30 p.m. revealed the following:
EF# 2, Date of Hire (DOH), 12/1/2023: Agency failed to provide documentation of proof of Pa. residency for the entire two years (without interruption) immediately preceding the date of application. Contained West Virginia Drivers License issued 3/2/2021-2/7/2027.
EF# 10, DOH, 1/11/2024: Agency failed to provide documentation of proof of Pa. residency for the entire two years (without interruption) immediately preceding the date of application. Contained Pennsylvania Junior Learners Permit issued: 6/17/2022-6/17/2023 and Pennsylvania Identification Card issued 12/28/2023-12/31/2027. No documentation of Pennsylvania proof of residency between date range of: 1/11/2024-6/17/2022.

An interview with the agency EMP #1 conducted on February 22, 2024 at approximately 2:30 p.m. confirmed the above findings.







Plan of Correction:

MedStaffers is required to run the following background clearances upon hire and then every 5 years of employment with MedStaffers:
- Pennsylvania State Police
- Child Abuse- (only if working with a client under the age of 18 or in a home that has children under the age of 18)
- FBI Fingerprints- (if working with a client under the age of 18 or in a home that has children under the age of 18) OR for proof of residency in the Commonwealth for at least 2 years preceding the date of hire.

FBI check for the purposes of proof of residency will be done for EF#2 and EF# 10

Human Resources will be responsible for setting up the FBI fingerprint appointments and processing the background checks as necessary.
